Vishwamurthy, HCGP) This criminal petition is filed under section 439 of Cr.P.C., praying to enlarge the petitioner on bail in Crime No.171/2016 (S.C.No.05/2017) of Harapanahalli police station, Davanagere District, for the offence p/u/s 302 of IPC, etc.
This criminal petition coming on for orders this day, the Court made the following:
ORDER Heard the learned counsel appearing for the petitioner and the learned High Court Government Pleader for respondent-State.
2. The petitioner is charge sheeted by the respondent-police in their Crime No.171/2016 in respect of the offence punishable under Section 302 of IPC.
3. As per the submission at Bar, trial is in progress and already seventeen witnesses are examined. In that view of the matter, it is not in fitness of things to consider the petition on its merits.
Hence, petition is rejected.
However, the trial Court is directed to expedite the trial and conclude within an outer limit of three months from the date of communication of this order.
