The present bail application has been filed by the applicant in Case Crime No.133 of 2018, u/s 376(2)(Cha), 506 IPC and section 5Da/6 of POCSO Act, P.S. Khoda, District Ghaziabad with the prayer for enlarging him on bail.
Having heard learned counsel for the applicant, learned AGA for the State and considering the fact that the victim is aged about 6-7 years and there is consistent version in the statement u/s 161 and 164 Cr.P.C. that the applicant has sexually assaulted her, I do not find it to be a fit case for enlarging the applicant on bail.
The bail application is, accordingly, rejected.
However, the applicant is in jail since 25.2.2018, the trial court is directed to expedite the trial and conclude the same preferably within the period of six months from the date of production of the certified copy of this order before the trial court.
