Heard learned A.G.A. and perused the record.
This revision has been filed against the orders dated 3.10.2009 and 4.3.2008 respectively passed by the Special Judge(S.C./S.T.) Act , Bareilly in Misc. Case No. 41 of 2007(Rakesh Agarwal vs. Shiva Raghu Vanshi and others) in criminal appeal no. 399 of 2008.
By the order dated 4.3.2008 passed by the trial court the record of the case was transferred to the competent court having jurisdiction for trial of the case under section 340 Cr.P.C. regarding the case under section 417 I.P.C.
Against both the orders revisionists have approached this court. A perusal of the orders shows that only order for filing complaint under section 340 Cr.P.C. before the competent court has been passed. No prejudice has been caused to the right of the revisionists by the order passed by the court below and the appeal preferred against the same has also been dismissed by order dated 3.10.2009.
In view of the above, impugned judgements and orders do not suffer from any illegality, infirmity or jurisdictional error requiring any interference by this court.The revision lacks merit and is liable to be dismissed Revision is accordingly dismissed.
Office is directed to communicate the court below regarding order passed by this court for proceedings with the case as expeditiously as possible.
