ORDER:
This writ petition is filed for the following substantive relief:
“….to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of respondent No.3 in issuing Lr.No. SC/OP/Tech/NZB/F.No.M&M/D.No.275/14, dated 24.05.2014, terminating the petitioner firm from contract and keeping in black list with immediate effect, as arbitrary, illegal and violative of Articles 14, 19(1)(g) and 21 of the Constitution of India and in violation of the principles of natural justice and consequently set aside the said Lr.No. SC/OP/Tech/NZB/F.No.M&M/D.No.275/14, dated 24.05.2014 issued by respondent No.3 and pass such other order or orders as this Hon’ble Court may deem fit and proper in the circumstances of the case.”
After arguing the case, Mr. Ponnam Ashok Goud, learned counsel representing Mr. K. Lakshman, learned counsel for the petitioner, requested for permission of the Court to withdraw the writ petition with liberty to his client to avail the common law remedy of a civil suit for damages for the alleged unlawful termination of contract by the respondents.
The writ petition is accordingly dismissed as withdrawn, with liberty to the petitioner in terms of the prayer made.
As a sequel to the dismissal of the writ petition, W.P.M.P.No.37096 of 2014 shall stand disposed of as infructuous.
