1. Heard Mr. Nanavati, learned advocate for the petitioner.
2. The petition involves issue about the dues of previous owner. Though the property is purchased in auction, the electricity company is demanding payment of previous owner from the subsequent purchaser. Such demand is brought under challenge in present petition.
3. Mr.
Nanavati, learned advocate for the petitioner has relied on decision in case of Abhisar Developers vs. Torrent Power Limited, reported in 2010 (3) GLH 356. He has relied on the decision in case of Sona Cooperative Housing Society Limited vs. Gujarat Electricity Board, reported in (2003) 3 GLR 2234. He has also relied on an interim order passed by the Court in Special Civil Application No.3113 of 2012.
