Heard Mr. B.M. Mangukiya, learned advocate for the applicant.
The applicant being aggrieved by the judgment and award passed by Ex-officio Commissioner for the Workmen's Compensation Act and Judge, Labour Court (Senior Division), Junagadh, filed the appeal but for non-removal of office objection it came to be dismissed and an application for restoration of above appeal is filed but their appears to be delay in filing the above application for restoration of appeal. It is submitted that reasons are stated for the delay caused in filing application for restoration.
Considering overall facts and circumstances and submissions made by learned advocate for the applicant in paragraphs 7 to 12, I am inclined to condone the delay caused in filing the application for restoration.
This application is allowed accordingly. No costs.
Registry is directed to place application for restoration on board on 18.6.2012.
