Krishna Kumar Singh, learned counsel for the petitioner after arguing for some on instructions prayed that he is not pressing the prayers made in the writ petition as the petitioner is desirous to take alternative remedy to challenge the order of appointment of fair price shop to respondent no.6 and impugned order as provided under the Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016 in accordance with law. He further submitted that the delay in availing the alternative remedy be condoned.
Considering the aforesaid submissions, prayers in this writ petition are rejected and this writ petition is disposed of with the direction that authority will consider the time period when writ petitions filed by the petitioner were kept pending before this Court, while considering the delay application filed by the petitioner, while approaching the authority by way of alternative remedy.
Awadhesh Kumar Malviya, has appeared on behalf of respondent no.5.
