1. Called in revise. None appeared to press this revision. In the circumstances, I myself have perused the record.
2. This criminal revision under Section 401 read with Section 397 Cr.P.C. has been filed aggrieved by judgment and order dated 05.8.1993 passed by Sri D.C.Srivastava, Sessions Judge, Muzaffarnagar in Criminal Appeal No.2 of 1993 whereby appeal of revisionist has been partly allowed. Order of conviction of revisionist under Sections 323 and 324 IPC has been maintained and sentence awarded by Assistant Sessions Judge is reduced from six months to three months under Section 323 and two years to one year under Section 324 IPC.
3. Having gone through the record, I do not find any manifest error or otherwise illegality, procedural or otherwise, so as to justify interference in criminal revision.
4. Dismissed.
5. Interim order, if any, stands vacated.
6. The accused, Shiv Shanker Lal is on bail. His bail bonds and surety bonds are cancelled. The Chief Judicial Magistrate concerned shall cause him to be arrested and lodge in jail to serve out the sentence passed against him. The compliance shall be prepared within two months.
7. Certify this judgment to the lower Court immediately.
