Present writ petition is filed by the petitioners with the prayer to direct the respondent no. 1 to decide the pending application dated 29-11-2008(No.3-Ka1) for Kattai decree "Shiv Prasad Pandey Versus Rajpala and Others' Under Order 20, Rule 18 C.P.C., inre; original suit no. 233 of 1998 "Shiv Prasad Pandey Versus Ram Padarath' within stipulated period fixed by this court.
Looking into the facts and circumstances of the case, respondent no. 1, Civil Judge(Junior Division)Kunda, District-Pratapgarh, is directed to consider and decide the pending application dated 29-11-2008(No.3-Ka1) for Kattai decree "Shiv Prasad Pandey Versus Rajpala and Others' Under Order 20, Rule 18 C.P.C., inre; original suit no. 233 of 1998 "Shiv Prasad Pandey Versus Ram Padarath' within a period of four months from the date a certified copy of this order is placed before him.
With the aforesaid, present writ petition is disposed of.
