Shiv Shankar vs State Of U.P. Thru. Prin. Secy. ...

High Court Of Judicature at Allahabad|18 May, 2021

JUDGMENT / ORDER

Hon'ble Saurabh Lavania,J.
Heard learned counsel for the petitioner and learned counsel for the private opposite party.
The Court has perused the order dated 24.04.2021 passed in P.I.L. No. 564 of 2020 wherein certain protections have been given during Covid-19 Pandemic. The petitioner's grievance is that ignoring this order the A.C.O. is proceeding in execution to the order passed under Rule 109-A of the U.P. Consolidation of Holdings Rules 1954 for execution of the judgment passed by the C.O. as modified by the S.O.C. under the Act 1953, even when the revision of the petitioner as also the interim relief application therein are pending before the D.D.C.
Learned counsel for the private opposite party submits that the matter is now fixed in July, 2021.
Be that as it may, let the petitioner file a copy of the order dated 24.04.2021 referred hereinabove before the A.C.O. concerned who shall look into the same and shall not violate it, if the order is applicable to the proceedings pending before him.
The Revisional Court is directed to dispose of the revision of the petitioner, if there is no other legal impediment, at the earliest, say within 3 months, as already ordered by this Court in the earlier writ petition. If it is not possible to do so for some reason, he shall dispose of the interim relief application within 3 weeks.
With the above observations/directions this writ petition is disposed off, without prejudice to the rights of the parties in the pending proceedings on merits as and when the occasion arises.
