Heard learned counsel for the petitioner; the learned A.G.A. for the respondents 1 and 2; and perused the record.
The instant petition seeks quashing of the first information report dated 24.07.2018 registered as Case Crime No. 196 of 2018 at P.S. Lohta, District- Varanasi, under Sections 363, 366 I.P.C. and section 7/8 Pocso Act.
The allegations made in the impugned first information report disclose commission of cognizable offence and from the statement of the victim recorded under Section 164 Cr.P.C., which is at page 50, even an offence of rape is, prima facie, made out. The petitioner is named in the statement of the victim recorded under Section 164 Cr.P.C.
The petition is dismissed.
