Heard the learned counsel for the applicant and the learned A.G.A. for the State.
Learned counsel for the applicant points out that the applicant is the father-in-law of the deceased and the co-accused Smt. Geeta Devi against whom there are similar allegations has been granted bail by an earlier order dated 22.10.2009 passed by Hon'ble Ravindra Singh, J., in which it is observed that the deceased may have died a natural death and that the F.I.R. was lodged on an application under section 156 (3) Cr. P. C.
Learned A.G.A. could not dispute this position.
Having heard the submissions of the learned counsel for the parties and without expressing any opinion on the merits of the case, let the applicant Shiv Shanker Gond, involved in Case Crime No. 300 0f 2009, under sections 498A/504, 506, 352, 304-B, 201 IPC and 3/4 Dowry Prohibition Act, Police Station Kotwali Ballia, district Ballia, be released on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the Court concerned.
