JUDGMENT / ORDER

Heard learned counsel for the petitioner and learned Standing counsel for appearing for respondents By means of present writ petition, the petitioner has prayed for quashing the order dated 04.09.2014 passed by the respondent no.2 in appeal no. 192 of 2005 and order dated 22.09.2014 passed by the respondent no.3.
It appears that respondent no.2 has issued recovery citation of Rs. 1,65,632/- on 30.12.2004 against the petitioner's vehicle.
Aggrieved with the said recovery proceeding the petitioner has filled an appeal no. 96 of 2005, which was allowed vide order dated 26.04.2005, and matter was remanded back with the direction to the taxing officer, ARTO, Chitrakoot, to look into the matter and decide as per law. Thereafter, the respondent no.3 had proceeded in the matter and passed demand notice of Rs. 1,15,624/- on 11.07.2005.
Learned counsel for the petitioner submits that aggrieved with the said order he had again filed an appeal no. 192 of 2005 and an interim order was initially granted but finally the same was dismissed vide order dated 04.09.2014.
The matter requires consideration.
Issue notice to respondents. Steps may be taken within a week, returnable at an early date. The respondents are allowed three weeks' time to file counter affidavit. The petitioner will have one week thereafter to file rejoinder affidavit.
List this matter after four weeks.
Till the next date of listing the order impugned dated 22.09.2014 shall be kept in abeyance subject to deposit of Rs. 2,25,000/- within three weeks time from today.
