Heard learned counsel for the petitioner, learned A.G.A. and perused the record.
Learned counsel for the petitioner has submitted that Sushma Verma and Rupesh alias Rupam Verma were named in the F.I.R., but, no charge sheet was filed against them, but, during trial the parents of deceased, who have been examined as P.W.-1 and P.W.-2 have given evidence against the said accused, but, inspite of it, the learned trial court has rejected the petitioner's application under Section 319 Cr.P.C. for summoning the said co-accused to face joint trial with the accused.
Issue notices to the opposite parties nos. 2 to 5 returnable at an early date.
Let the steps be taken within a week.
Learned A.G.A. as well as opposite parties nos. 2 to 5 may file counter affidavit within three weeks. Rejoinder affidavit, if any, may be filed within one week, thereafter.
List immediately after expiry of said period alongwith service report.
Till the next date of listing, further proceedings in S.T. No. 830 of 2008, State Versus Satya Prakash and another, pending in the court of Learned Session Judge, Unnao, shall remain stayed.
