1. Sri Bhishm Pal Singh, learned counsel for the petitioner. Sri Pankaj Kumar Singh, learned counsel for respondent nos. 3 and 4.

This writ petition has been filed by the petitioners claiming that on 9.12.2014, State Government issued a government order notifying recruitment for filling up 50,000 post of Assistant Teachers in primary schools run by Board of Basic Education in different districts of the State. Thereafter, petitioner too applied for one of the post of Assistant Teacher. It is mentioned in the writ petition that though no modalities were specified for conducting selection proceedings, but it was generally notified that earlier notified procedure contained in government order dated 15.10.2013 will be followed.

Petitioners' contention is that in the district of Etawah, 250 posts of Assistant Teachers were notified out of which a select list of 235 candidates was prepared but certain candidates did not join. Thus some of the petitioners had approached this Court by filing Writ Petition No. 45768 of 2016, which was disposed of vide order dated 23.9.2016.
4. It is submitted that after passing of order dated 23.9.2016. some persons have been given appointment, but petitioners have not been so fortunate and therefore this writ petition.

Sri Pankaj Kumar Singh, learned counsel for respondent nos. 3 and 4 submits that after order passed by coordinate bench of this Court in Writ A No. 45768 of 2016, Sachin Pratap Singh and others Vs. State of UP and others, District Basic Education Officer, Etawah has disposed of petitioner's representation through a speaking order dated 3.1.2017 in which it is specifically mentioned that 243 candidates were selected and not 250 candidates. It is submitted by reading paragraphs from the impugned order, which is extracted as under :-
याचीगण द्वारा उपरोक्त रिरक्त पदों पर उनकी भर्ती3 किकया जाने सम्बन्धी प्रार्थ!ना माननीय उच्च न्यायालय से की गयी। सन्दभ!गर्ती भर्ती3 प्रकि&या में उपरोक्तानुसार रिरक्त पदों पर मा० उच्च न्यायालय इलाहाबाद द्वारा पारिरर्ती आदेश किद०- 23.09.2016 के समादर में किदये गये किनद.शों का अनुपालन किकये जाने हेर्तीु इस काया!लय के पत्र संख्या-6618 किद०-28.10.2016 एवं पत्र संख्या-6993 किद०-12.11.2016 एवं पत्र संख्या-7808 किद०-05.12.2016 द्वारा सचिचव बेसिसक शिशक्षा परिरषद उ० प्र० इलाहाबाद से उक्त भर्ती3 प्रकि&या में पूव! में काउन्सलिंलग कराये हुये अभ्यर्थिर्थयों/ याचीगणों से पदो को भरने के लिलये अपेचिक्षर्ती/वांशि?र्ती अनुमचिर्ती माँगी गयी किकन्र्तीु अपेचिक्षर्ती अनमचिर्ती प्राप्त नहीं होने एवं मा० उच्च न्यायालय इलाहाबाद के आदेश का अनुपालन करने हेर्तीु सिजला चयन सकिमचिर्ती की सम्पन्न बैठक 27.12.2016 में लिलये गये सव!सम्मर्ती किनण!य के अनुसार उपरोक्तानुसार रिरक्त पदों पर चयन हेेर्तीु मा० न्यायालय द्वारा किदये गये किनद.शों के अनुपालन में इस काया!लय के पत्रांकः 8431-39 किद०-28.11.2016 के द्वारा दो समाचारपत्रों दैकिनक आज एवं राष्ट्रीय सहारा में किवज्ञाकिप्त प्रकाशिशर्ती करवार्तीे हुये काउन्सलिंलग / मूल अशिभलेखों के किमलान की चिर्तीशिर्थ 29.12.2016 किनधा!रिरर्ती की गयी सिजसकी किवचिधवर्ती् सूचना समाचारपत्रों के सार्थ -सार्थ याचीगणों को भी दी गयी। किदनांक-29.12.2016 को उपरोक्तानुसार प्रकाशिशर्ती किवज्ञकिप्त के &म में पूव! में काउन्सलिंलग हेर्तीु उपस्थिMर्थर्ती अभ्यर्थिर्थयों के अचिर्तीरिरक्त कु ल 04 अभ्यर्थ3 इस काउन्सलिंलग में और उपस्थिMर्थर्ती हुये सिजन्हें प्रर्थम दृष्टया अह! पाये जाने पर पूव! में र्तीैयार की गयी मदर सूची में सस्थिम्मलिलर्ती किकया गया। इस प्रकार पव! में बनायी गयी मदर सूची में सस्थिम्मलिलर्ती करने के उपरान्र्ती नवीन रुप से र्तीयारै की गयी मदर सूची में कु ल 269 (पव! की मदर सूची के 272 में से 07 किनरMर्ती अभ्यर्थिर्थयों को ?ोड़कर शषे बचे 265 अभ्यर्थिर्थयों में वर्ती!मान 04 अभ्यर्थिर्थयों को जोड़कर ) अभ्यर्थिर्थयों को मेरिरट के &म में नवीन मदर सूची र्तीैयार की गयी सिजसमें से किवभागीय किनयमानुसार रिरशफलिंलग प्रकि&या के उपरान्र्ती वग! / श्रेणीवार आवंकिटर्ती पदों के सापेक्ष चयन की काय!वाही सम्पन्न की गयी सिजसका किववरण किनम्नवर्ती् है-
उपरोक्तानुसार मा० उच्च न्यायालय के आदेश के अनुपालन में सन्दभ!गर्ती भर्ती3 प्रकि&या में कु ल 246 अभ्यर्थिर्थयों का चयन किकया गया किकन्र्तीु अनुसूचिचर्ती जनजाचिर्ती के अभ्यर्थिर्थयों की अनुपलब्धर्तीा के कारण 04 पद अभी भी रिरक्त बने हुये हैं र्तीर्था इस प्रकार नवीन सिसरे से समाचारपत्रों में कु ल 14 रिरक्त पदों पर भर्ती3 किकये जाने हेेर्तीु प्रकाशिशर्ती किवज्ञापन के &म में किदनाँक -29.12.2016 को सम्पन्न काउन्सलिंलग के उपरान्र्ती वग! / श्रेणीवार रिरक्त पदों पर चयकिनर्ती होने वाले अभ्यर्थिर्थयों का किववरण किनम्नवर्ती् है-
अनारचिक्षर्ती श्रेणी में नवीन चयकिनर्ती
किप?ड़ी वग! श्रेणी में नवीन चयकिनर्ती
अनु० जाचिर्ती वग! श्रेणी में नवीन चयकिनर्ती
उपरोक्त किववरणानुसार चयकिनर्ती अभ्यर्थिर्थयों के सम्बन्ध में उल्लेखनीय है किक अनारचिक्षर्ती वग! में कु ल 07 अभ्यर्थ3 किवभागीय रिरशफलिंलग प्रकि&या के बाद चयकिनर्ती हुये हैं सिजनमें सामान्य जाचिर्ती के 02 अभ्यर्थ3 (&मांक-4 एवं 5) नवीन चयकिनर्ती हुए है जबकिक किप?ड़ी जाचिर्ती के 03 अभ्यर्थ3 (&मांक-2,3 एवं 7) एवं अनु० जाचिर्ती के 02 अभ्यर्थ3 (&मांक-1 एवं 6) पव! से ही अपनी जाचिर्ती की श्रणीे में चयकिनर्ती र्थे , किकन्र्तीु वर्ती!मान में र्तीैयार की गयी अनस्थिन्र्तीम चयन सूची में वह मेरिरट के आधार पर अनारचिक्षर्ती श्रेणी में Mर्थान प्राप्त किकये हैं परिरणामMवरुप किप?ड़ी जाचिर्ती के 03 उपरोक्त अभ्यर्थिर्थयों के अनारचिक्षर्ती वग! श्रेणी में रिरशफल्ड हो जाने के कारण किप?ड़ी जाचिर्ती में उक्त 03 Mर्थान रिरक्त हो गये और किप?ड़ी जाचिर्ती में कु ल रिरक्त Mर्थान 02+03=05 हो गये सिजन पर नवीन सिसरे से मेरिरट के &म में चयन किकया गया है। इसी प्रकार अनु० जाचिर्ती के 02 उपरोक्त अभ्यर्थिर्थयों के अनारचिक्षर्ती वग! श्रेणी में रिरशफल्ड हो जाने के कारण अनु० जाचिर्ती में उक्त 02 Mर्थान रिरक्त हो गये और अनु० जाचिर्ती में कु ल रिरक्त Mर्थान 01+02=03 हो गये सिजन पर नवीन सिसरे से मेरिरट के &म में चयन किकया गया है। इसी प्रकार अन० जनजाचिर्ती वग! श्रणीे में वर्तीम! ान काउन्सलिंलग में भी किकसी भी अह! अभ्यर्थ3 के काउन्सलिंलग में उपस्थिMर्थर्ती नहीं होने के कारण उक्त श्रेणी के 04 पद अभी भी रिरक्त बने हुये हैं र्तीर्था किवशेष आरक्षण श्रेणी में भूर्तीपूव! सैकिनक Mवयं के रिरक्त चल रहे 01 पद पर भी किकसी भी अह! अभ्यर्थ3 के काउन्सलिंलग में उपस्थिMर्थर्ती नहीं होने के कारण उक्त श्रेणी का 01 पद अभी भी रिरक्त बना हुआ है सिजसके लिलये सकिमचिर्ती द्वारा लिलये गये किनण!य के अनुसार किकसी भी जाचिर्ती में पदो को आरचिक्षर्ती नहीं किकया गया है। उपरोक्तानुसार किवभागीय किनयमों के अन्र्तीग!र्ती मा० उच्च न्यायालय द्वारा पारिरर्ती आदेश के अनुपालन में सन्दभ!गर्ती भर्ती3 में रिरक्त 14 पदों पर चयन की काय!वाही किकये जाने हेर्तीु सिजला चयन सकिमचिर्ती द्वारा किदनाँक- 27.12.2016 को समपन्न बैठक में लिलये गये सव!सम्मर्ती किनण!यानुसार समाचारपत्रों मे किवज्ञापन प्रकाशिशर्ती करवाने के उपरान्र्ती किदनाँक-29.12.2016 को काउन्सलिंलग करवाकर चयन की काय!वाही की गयी। इस प्रकार इस चयन में याचीगणों के चयन की स्थिMर्थचिर्ती किनम्न प्रकार है -
उपरोक्तानुसार मा० उच्च न्यायालय इलाहाबार्ती में योसिजर्ती याचिचका संख्या -45768/2016 सचिचन प्रर्तीाप सिंसह व अन्य बनाम उ०प्र० राज्य एवं अन्य में मा० न्यायालय द्वारा पारिरर्ती आदेश किदनाँक -
23.09.2016 के समादर में याचीगणों के संयक्त हMर्तीाक्षरिरर्ती प्रत्यावेदन किदनाँक -28.09.2016 एव 14.10.2016 का किवभागीय किनयमों के अन्र्तीग!र्ती किनयमानुसार एर्तीद्द्वारा किवचिधसंगर्ती र्तीरीके से किनMर्तीारण किकया जार्तीा है।

It is evident from the table extracted above that petitioner nos. 1 to 7 have failed to secure minimum prescribed qualifying marks under the individual categories and therefore their name could not be recommended for appointment on account of they not qualifying bench marks prescribed for the respective categories.

It is evident that petitioner's candidature was not found to be suitable for selection and found to be included in the list of 250 candidates, out of which 7 were disqualified on account of miscellaneous reasons like not fulfilling basic qualification of B.Ed. etc, due to non verification of their mark sheets produced by them from Central Board of Education, Ajmer / New Delhi and no wait list was since prepared, Therefore, petitioners having not find place in the list of 250 selected candidates are not eligible for appointment.

As far as petitioner no. 8 is concerned, there is no averment in the writ petition that Abhishek Yadav, who belongs to OBC category had secured more than cut off mark i.e. 68.50 prescribe for OBC category. In fact, he had secured 62 marks as is evident from the document available on record, which is below the prescribed cut off marks of 68.50 and on this ground even Abhshek Yadav is not eligible for appointment. Even otherwise when counsel for the petitioner is specifically asked as to whether there was any provision for wait list, whether the names of the petitioners were mentioned in the wait list, operation of which have been sought by the petitioners then counsel for the petitioner Sri Bhishm Pal Singh submits that there was no provision for wait list and petitioners name did not find mention in the wait list. Thus in the light of decision of this Court passed by Division Bench of this Court in Special Appeal Defective No. 421 of 2021; Arvind Singh Vs. State of UP and others it is evident that if scheme of recruitment does not provide for preparation of wait list and wait list was not prepared then a person without finding place in wait list cannot claim any vested right to be appointed that certain persons not joining posts on which their names were recommended. In view of such legal position and as also submitted by the counsel that there was no provision for preparing wait list either in the scheme of notification dated 9.12.2014 so also in government order dated 15.10.2013, there is no ground for interfering in the matter and extend any benefit as has been prayed by the petitioners. Thus writ petition fails and is dismissed.
