Heard Sri Ram Om Vikram Singh Chauhan, learned counsel for the petitioner, Sri Rohit Yadav, learned counsel for the respondent Bank and learned Standing Counsel for the respondent nos.1, 2, 3 and 4.
With the consent of learned counsel for the parties, this writ petition is disposed of at the admission stage.
The petitioner earlier filed a writ petition being Writ C no.76686 of 2011 which was disposed of by this Court vide the order dated 03.01.2012. The conditions so stipulated in the order dated 03.01.2012 are not fulfilled therefore the respondent Bank has proceeded and has issued the notice of recovery of the due.
The contention of counsel for the petitioner is that the recovery notice issued by the respondent Bank is figuring highly excessive amount whereas the substantial amount has already been paid by the petitioner.
In pursuance of the order of this Court, learned counsel for the bank has obtained the instructions and placed the same for perusal.
Admittedly, the respondent Bank has proposed 'one time settlement scheme, 2018' which was extended time to time and vide letter dated 28.05.2019, the said 'one time settlement scheme' is operating till 30.06.2019.
The one time settlement scheme provides certain concession to the borrower if the borrower fulfil the conditions so stipulated in the said scheme.
Learned counsel for the petitioner agrees to opt one time settlement scheme introduced by the respondent Bank.
In view of above, this petition is disposed of by directing the petitioner to approach the respondent no.5 (Bank) within a period of 10 days from today and submit the certified copy of this order as well as the application for opting the one time settlement scheme.
In case, if the petitioner approaches the Bank within 10 days from today the impugned recovery will be kept in abeyance till decision taken by the Bank.
The writ petition is disposed of. Order Date :- 31.5.2019 A.Kr.*
