1. Heard learned counsel for the petitioner and Sri Alok Sharma, learned Additional Chief Standing Counsel for the State-respondent.
2. It is the case of the petitioner that he was appointed on the post of Takabi Amin on 13.11.1968 and continued to discharge his duties till 1975. The post of Takabi Amin was abolished and the petitioner alongwith other employees were treated to be retrenched employees. Thereafter, on 21.3.1978, the petitioner was appointed as Collection Amin in the revenue department and on completion of satisfactory service, he retired from service on 25.5.2007.

Learned counsel for the petitioner submits that as per the government order issued on 24.7.2018, the petitioner is entitled for the grant of second promotion pay scale on completion of 24 years of service as he has completed the said required service on 21.3.2002. He submits that for consideration of claim for the grant of second promotional pay scale, the petitioner has represented the matter before the respondent No.1 on 25.2.2021, which is lying pending consideration. He submits that in case direction is issued to the respondent No.1 for consideration of claim of the petitioner on the pending representation in accordance with the government order issued on 24.7.2018 and to pass appropriate order in a reasonable time, justice would be met.

On the other hand, learned Additional Chief Standing Counsel submits that the cut off date fixed under the government order is of the year 2003 and in case the petitioner has completed 24 years service till the cut off date, his claim shall be considered and appropriate order shall be passed within a reasonable period.
5. I have considered the submission advanced by learned counsel for the parties and perused the material on record.
6. On perusal, it is evident that there is a government order in regard to the grant of second promotional pay scale to the employees by fixing a cut off date as 16.8.2003. It is the case of the petitioner that he has completed the required 24 years of service on 21.3.2002 and is entitled for the grant of second promotional pay scale.
7. In view of the above, no useful purpose will be served in keeping the writ petition pending.

Accordingly, the writ petition is finally disposed of with the direction to the respondent No.1 to consider and pass appropriate reasoned speaking order taking on the representation dated 25.2.2021 in accordance with law within a period of six weeks from the date of production of certified copy of this order.
9. It is however made clear that the order passed in compliance of the order passed by this Court shall be communicated to the petitioner thereafter by the respondents.
