JUDGMENT / ORDER

Learned counsel for the petitioner asserts that the petitioner is eligible to be promoted to the post of Lecturer (History), as he is M.A. (History) and has five years' experience as a Teacher in L.T. Grade. The respondents, however, are not allowing promotion to the petitioner on the ground that the petitioner passed M.A. in the year 2008, whereas the vacancy arose in the year 2009. It has further been asserted that the rule does not provide anywhere that a Teacher in L.T. Grade having M.A. qualification was required to have five years' experience.
Five years' experience is a separate requirement and qualification of M.A. is a separate requirement.
Sri Pankaj Patel, Advocate, appearing for respondent nos.1 to 4 prays for time to file counter affidavit.
Let notice be issued to respondent nos.5 and 6, returnable in four weeks.
Any promotion made in the meantime, shall remain subject to result of this petition.
