Heard Sri Akhilesh Kumar holding brief of Sri Rajesh Mishra, learned counsel for the petitioner, Sri Ashok Kumar Yadav, learned counsel for the respondent no.2 and the learned Standing Counsel for the respondent no.1.
The petitioner in the writ petition is seeking a direction to the respondents to pay salary for the month of November, 2008 with 18% interest.
It is stated that by the letter dated 21.04.2008 the Assistant Basic Education Officer had informed the petitioner that the salary for the month of November, 2008 was being withheld because the PPO had not been received in his office for which the petitioner and similarly situated persons were solely responsible.
Question is what was the petitioner doing for the last 10 years and why he has approached this Court only now by this writ petition after 10 years.
In my opinion, this writ petition is grossly barred by laches and is accordingly dismissed as such.
