Heard learned counsel for the parties.
The applicant has preferred the present contempt application for non-compliance of judgment and order dated 07.01.2019 passed in Civil Writ-C No. 42325 of 2018 (Shiv Poojan Vs. State of U.P. And 6 Others). The aforesaid order is quoted below:-
"The grievance of petitioner is that the respondents have raised construction on the land bearing Gata No. 414, measuring area 0.085 hectare, situate at Village Bahiri, P.S. Chandwak, Pergana and Tehsil Kerakat, District Jaunpur. The land aforesaid, according to the petitioner is under title of the petitioner. The petitioner in this regard submitted a representation before respondent no.2- Collector/District Magistrate, Jaunpur on 08.10.2018 that has not been considered and decided so far.
Looking to the facts and circumstances of the case, we deem it appropriate to dispose of this petition for writ by directing the District Magistrate, Jaunpur to consider and decide the representation aforesaid submitted by the petitioner by a speaking and reasoned order. An opportunity of personal hearing be also given to the petitioner, if demanded.
With the above terms, the writ petition stands disposed of."
It is stated that though the copy of judgment has been duly served upon the District Magistrate, Jaunpur but till date no decision has been taken.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the District Magistrate, Jaunpur to pass an appropriate orders as directed by the writ court in accordance with law expeditiously and preferably within a period of three months from the date of submission of self attested computer generated copy of this order downloaded from the official website of High Court Allahabad but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, except upon payment of cost if there is no legal impediment.
