Heard Sri Vinod Kumar Singh, learned counsel for the petitioner, Sri Arun Kumar, learned counsel for the respondent no.3 and learned standing counsel for the respondents no. 1 and 2.
The five petitioners in the writ petition are seeking a direction to the respondent no.1 to pass appropriate order on the report of Khand Shiksha Adhikari, Badahalganj, Gorakhpur dated 20.1.2018 with regard to sanction for payment of salary to the petitioners.
It is stated that earlier the Committee of Management, Visen Junior High School has filed Writ petition no. 53835 of 2016 (C/M Visen Junior High School Vs State of U.P. and others) seeking a direction to the respondents for payment of salary to the Teachers and staff of primary section attached to the Junior High School. That writ petition was disposed of by this court by order dated 11.11.2016 with a direction to the respondent no.1- State Government to take a decision in the matter. The State Government by its letter issued by the Joint Director of Education (Female), Basic dated 28.12.2017 called for a report on 16 points from the District Basic Education Officer, Gorakhpur. It is stated that the Khand Shiksha Adhikari, thereafter has submitted his report on 20.1.2018, Annexure-7 to the writ petition.
No useful purpose would be served in keeping the petition pending.
This writ petition is, therefore, disposed of with a direction to the respondent no. 1-Secretary, Department of Basic Education, Government of U.P., Lucknow to take a decision in the matter considering the report of the Khand Shiksha Adhikari under the covering letter dated 20.1.2018, Annexure-7 to the writ petition and in accordance with law, expeditiously preferably within a period of three months from the date of receipt of a certified copy of this order in his office.
It is made clear that the court has not adjudicated the claim of the petitioners on merit.
