Heard learned counsel for the petitioner; learned A.G.A. for the respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the first information report dated 13.11.2019 registered as Case Crime No.352 of 2019, under Sections 419, 420, 468, 471 IPC, P.S. Kopaganj, District Mau.
The allegations made in the impugned first information report are to the effect that the petitioner had passed his High School in the year 2005 and thereafter he did his graduation in the year 2010 and in order to ensure that he does not become overage for the purposes of recruitment, he appeared again in the High School Examination in the year 2010 so as to get his date of birth changed and age reduced and, thereafter, by taking advantage of reduced age, on another appearance, secured appointment.
The contention of the learned counsel for the petitioner is that there would be no creation of false document and otherwise also the allegations are false inasmuch as in one mark-sheet an alias name is also disclosed.
Be that as it may, as all the aforesaid aspects would require investigation, the prayer to quash the first information report cannot be accepted.
The petition is dismissed without prejudice to the right of the petitioner to apply for bail or anticipatory bail, as may be advised.
