Under order of Writ Court dated 27.02.2018, the applicant was given liberty to apply for withdrawal of the money outstanding to his credit in his saving bank account. There was a further direction that the bank would permit the applicant to withdraw 50% of the amount from his saving bank account preferably within three weeks from the receipt of certified copy of the order and balance amount within six months.
There is no material on record to show that the the applicant filed a withdrawal slip or a cheque for withdrawal of the amount from his saving bank account, although he is stated to have filed an application alongwith certified copy of the order. Since the normal procedure for withdrawal of money from bank account has not been followed, therefore, I am not inclined to proceed further in the instant matter, but leaves it open to the applicant to submit a withdrawal slip alongwith certified copy of the order of the Writ Court and the instant order before the bank, and if, even thereafter, the amount is not permitted to be withdrawn as per direction issued by the Writ Court, it shall be open to the applicant to approach this Court by way of a fresh petition.
The contempt application is disposed of accordingly.
