Heard Sri Madhup Narain Shukla, learned counsel for the petitioners and learned Standing Counsel for the State respondents.
Notice need not be issued to the private respondents in view of the order proposed to be passed.
The petitioner is before this Court with the request to command the Commissioner, Basti Division, Basti to decide the stay application dated 14.3.2018 filed in by the petitioners in Revision No.C-201817000000279 (Shiv Prasad and another vs. Ram Milan and others). The request has also been made to decide the revision expeditiously and till the disposal of the stay application, parties may maintain status quo over the property in dispute.
In the facts and circumstances of the case, without expressing any opinion on the merits of the case, the writ petition is disposed of finally with a direction to the Commissioner, Basti Division Basti (first respondent) to decide the stay application of the petitioner expeditiously, preferably within a period of three months from the date of production of a certified copy of this order before him, without granting unnecessary adjournments to either of the parties, except upon payment of cost but certainly after according opportunity of hearing to all the stake holders in the matter.
Till the disposal of the said application, parties shall maintain status quo as on today.
