Heard Sri Priya Ranjan Rai, learned counsel for the petitioner and the learned Standing Counsel for the respondents no. 1 to 3.
Sri Diwakar Singh, learned counsel has accepted notice on behalf of the respondent no.4.
The petitioner in the writ petition is seeking a direction to the respondents to remove the illegal encroachment of the respondents no.5 and 6 from Plot no. 242 area 0.0800 hectare, which according to him is recorded as Khalihan and plot no. 243 area 0.0570 hectares, which is recorded as Manure pit, situated in Village Shahpur, Tehsil Phoolpur, District Allahabad. The relevant extract of the revenue record has been filed as Annexure-1 to the writ petition.
No useful purpose would be served in keeping the petition pending.
This writ petition is, therefore, disposed of with a direction to the respondent no.3-Tehsildar, Phoolpur, District Allahabad to enquire into the matter and take appropriate action in accordance with law within a period of two months from the date of receipt of a certified copy of this order in his office.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
