Heard Sri Manoj Kumar Mishra, learned counsel for the petitioner and Sri Mata Prasad, learned Standing Counsel for the respondents.
The petitioner in the writ petition is seeking a direction to the respondents to declare the entire proceedings for the acquisition of the land of the petitioner as lapsed in view of the provisions of Section 24-A of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 as no compensation has been paid to him. However, the order at Annexure-3 to the writ petition shows that in respect of the same land compensation has been paid by the Special Land Acquisition Officer.
No useful purpose would be served by keeping this writ petition pending.
This writ petition is, therefore, disposed of with the consent of the learned counsel for the parties with a direction that if the petitioner submits a representation in this regard before the respondent no.3, District Land Acquisition Officer, Chitrakoot alongwith a certified copy of this order, the respondent no.3 shall take a decision on the said representation with regard to payment of compensation to the petitioner in accordance with law within a period of three months from the date a certified copy of this order is received in his office.
It is made clear that the Court has not adjudicated the claim of the petitioner on merits.
