Heard learned counsel for the applicant.
This petition alleges disobedience of an interim order dated 13 September 2000 in terms of which it was provided that if the appointment of the applicant has been made against the sanctioned strength of Class-III staff, the opposite parties would pay salary. It is not disputed that this petition came to be dismissed for want of prosecution on 10 March 2016. This petition was subsequently restored to the board of this Court on 24 August 2017. According to the learned counsel despite restoration of the writ petition to its original number the applicant is not being paid salary.
The Court finds itself unable to appreciate this submission since it is not stated anywhere in the petition that the applicant continued to work during the period 10 March 2016 to 24 August 2017. Additionally, the Court notes that the averments made in paragraph -19 are sworn on the basis of information received and therefore cannot possibly be countenanced.
The petition is consequently dismissed.
