Heard learned counsel for the appellant and learned A.G.A. for the State and perused the lower court's record.
Prayer for bail has been made on behalf of the appellant Shiv Nandan alias Prem Prakash, Neeraj, Angad and Babloo, who have been convicted by Additional Sessions Judge, Court No.12, district- Hardoi in Sessions Trial No.450 of 2010 arising out of case crime No.633 of 2009, under Section 302/34 and 201/34 I.P.C., Police Station-Kotwali Dehat, District- Hardoi.
It is submitted by the learned counsel for the appellant that this is a case of circumstantial evidence and the chain of circumstances is not complete. It is further submitted that there is no admissible evidence against the appellant.
Considering the facts and circumstances of the case without commenting upon merits of the case in our opinion appellant is entitled to be released on bail.
Pending appeal, above named appellants convicted in above Sessions Trial and case crime number shall be released on bail on their executing personal bond each and on furnishing two sureties each in the like amount to the satisfaction of the court concerned.
Till further orders realization of fine, if any, shall also remain stayed.
