Heard Sri G.S. Mishra, learned counsel for the petitioner and Sri Dhirendra Singh, brief holder for the respondents no. 1 to 4.
Sri M.K. Yadav, learned counsel has accepted notice on behalf of the respondent no.5.
The petitioner in the writ petition is seeking a direction to the respondents to remove the illegal encroachment of respondents no. 6 to 9 over Arazi no. 24 area 0.0130 hectare, recorded as Banjar, Araji no. 353 area 0.3630 hectare, Araji no. 450 area 0.6410 hectare, recorded as Khalihan and Araji no. 336 area 0.0310 hectare recorded as Navin Parti situated in Village Churamanpur, Pargana Shadibad, Tehsil Jakhania, District Ghazipur. The relevant extract of the revenue record has been filed as Annexure-1 to the writ petition.
No useful purpose would be served in keeping the petition pending.
This writ petition is, therefore, disposed of with a direction to the respondent no.4-Tehsildar, Tehsil Jakhania, District Ghazipur to enquire into the matter and take appropriate action, in accordance with law, within a period of two months from the date of receipt of a certified copy of this order in his office.
It is made clear that that court has not adjudicated the claim of the petitioner on merit.
