Heard learned counsel for the applicants, learned A.G.A. for the State and perused the record.
By way of the instant application, the applicants have sought for quashment of the proceeding in Misc. Case No.1336 of 2016, Anuradha Verma Vs. Shiv Mohan Verma and others, under Section 12 of Protection of Women from Domestic Violence Act, Police Station Kotwali, District Etawah, pending before the Judicial Magistrate, Court No.1, Etawah.
Urge made on behalf of the applicants is confined to the ambit that three cases instituted / lodged by opposite party no.2 may be clubbed together at district Etawah so that the applicants may not be compelled to appear before the different courts at different districts in the proceeding initiated by opposite party no.2.
Upon perusal of the averments made in the accompanying affidavit and upon consideration of document annexed therewith, it is obvious that such prayer cannot be allowed by this Court, for the reason that clubbing of various proceeding of the different nature would have effect of delaying proper disposal of each and every proceeding. Therefore, no such order can be passed by this Court because cause of action arose at different districts.
With the above direction, the instant application under Section 482 Cr.P.C. is finally disposed of.
