Heard Sri Pramendra Kumar Singh, learned counsel for the petitioner and Sri Pradeep Kumar Singh, learned Additional Chief Standing Counsel for the opposite parties.
By means of this writ petition, the petitioner has prayed that he may be extended the benefit of judgment and order dated 26.05.2017, passed by this Court in Writ Petition No.11816 (S/S) of 2017; Ram Dhari Singh vs. State of U.P. & others, which is contained as Annexure No.2 to the writ petition.
Learned counsel for the petitioner has submitted that the impugned order dated 23.06.2018, as contained in Annexure No.1 to the writ petition has been received under R.T.I., has been passed in violation of the settled proposition of law and this Court vide judgment and order dated 26.05.2017 has considered the identical facts and passed final order to that effect.
Per contra, Sri Pradeep Kumar Singh, learned Additional Chief Standing Counsel has submitted that Annexure No.1 to the writ petition is an order obtained by the petitioner under R.T.I., therefore, he will have to seek complete instructions in the matter as to whether the petitioner may be extended the benefit of judgment and order dated 26.05.2017 passed by this Court in Writ Petition No.11816 (S/S) of 2017.
List this case on 04.09.2018 as fresh to enable the learned Additional Chief Standing Counsel to seek complete instructions in the matter.
