Heard learned counsel for the petitioner and learned State Counsel. Shri Jai Kumar has also been heard for the Gaon Sabha concerned.
In view of the proposed order, requirement of issuance of notice to the respondent nos.2 to 5 is hereby dispensed with.
Considering the innocuous nature of prayer made by learned counsel for the petitioner, the writ petition is finally disposed of with the direction to respondent no.1 to expedite the proceedings of recall application dated 14.03.2016 moved in Case No.T201808300506380, under Section 176 of U.P.Z.A. & L.R. Act and conclude the same expeditiously, say, within a period of three months from the date a certified copy of this order is produced before the court concerned, if there is no legal impediment.
It is further directed that the parties to the case shall not seek any unnecessary adjournment, neither any such adjournment shall be granted by the court concerned, except in exceptional circumstances.
