Supplementary affidavit filed today by learned counsel for the applicant is taken on record.
Heard Sri Shamshad Ahmad, learned counsel for the applicant and Sri I.P. Srivastava, learned A.G.A. for the State.
The first two bail applications of the applicant were rejected by this Court vide order dated 9.7.2014 and 26.8.2016, hence this third bail application has been moved on behalf of the applicant.
The new ground which has been argued by the learned counsel for the applicant is that while rejecting the bail applications of the applicant this Court twice given direction to the trial court to conclude the trial of the present case but in spite of the same the trial has not been concluded as yet, hence the applicant may be released on bail, who is in jail since 22.1.2014.
Learned A.G.A. has vehemently opposed the prayer for bail and has submitted that from a perusal of the order-sheet of the trial court the trial is at verge of its completion.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Shiv Kumar involved in Case Crime No. 56 of 2014 under sections 363, 364A, 368, 34 I.P.C., police station Kotwali Orai, District Jalaun.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within a further period of three months from the date of production of a certified copy of this order.
