Heard learned counsel for the petitioner and Mrs. Archana Singh, learned AGA-I for the State-respondent.
The instant writ petition has been preferred with a prayer to direct the authority concerned for submitting the progress report and ensuring fair investigation in Case Crime No. 178 of 2020, under Section 302 IPC, P.S. Kachhawan, District Mirzapur.
On the basis of instructions, learned AGA-I apprised that in the present case crime, the co-accused has been arrested by the police and the charge-sheet has been forwarded to the superior official.
In the facts and circumstances, once the matter is ceased before the competent authority there is no reason or occasion to create doubt about the fair investigation at this stage. As such, the Court is not inclined to interfere under Article 226 of the Constitution of India in terms of the categorical instructions.
With the aforesaid observations, the writ petition stands disposed of.
