Heard Sri Sanjeev Kumar Singh, learned counsel for the petitioner and the learned Standing Counsel.
Bearing in mind the order which this Court proposes to pass, it is of the considered view that no useful purpose would be served in continuing this petition on the board of this Court any further.
The claim raised is in respect of the grant of the third A.C.P. benefits consequent to the petitioner having completed 26 years of service.
Learned Standing Counsel on instructions states that this claim shall be duly evaluated and considered by the second respondent who shall pass a reasoned and speaking order within a period of two months from the date of presentation of a certified copy of this order along with a copy of the writ petition and its enclosures.
Accordingly and in light of the statement so made, which is recorded and accepted, nothing further survives on this petition, which shall in consequence stand disposed of.
It is however clarified that this Court has not ruled upon the merits or otherwise of the claim of the petitioner.
