Heard learned counsel for the petitioner and the learned Standing Counsel for the State.
Present writ petition has been filed beseeching expeditious disposal of restoration application dated 20.02.2021 filed by the present petitioner against the order dated 30.09.1992 passed by the Sub Divisional Officer in proceeding under Section 28 of U.P. Land Revenue Act, which is pending in the court of Additional District Magistrate (Finance and Revenue), Jaunpur (respondent no. 1).
It is submitted that proceeding under Section 28 of U.P. Land Revenue Act has been decided in favour of the father of respondent nos. 2 and 3 vide order dated 20.09.1992 passed in Case No. 697/1043 and 9053/1376. When the petitioner came to know about the aforesaid ex parte order, he moved a restoration application under Section 201 of U.P. Land Revenue Act. Notices were already issued to the respondents. It is submitted that normal dates are fixed in the matter without any fruitful step being taken by the court concerned.
Learned Standing Counsel states that he has no objection in case the aforesaid case is directed to be decided within a stipulated period fixed by this Court.
In this conspectus as above, no useful purpose would be served to keep this matter pending, therefore, this court deems it appropriate to finally dispose of the present writ petition, without making any observation on the merits of the case as mentioned in the present writ petition, with a direction to the Additional District Magistrate (Respondent No. 1), before whom the restoration application is pending, to decide the same expeditiously, preferably, within a period of six months from the date of receipt of a certified copy of this order.
It is expected that it should be decided by reasoned and speaking order, in accordance with law, after affording opportunity of hearing to the parties concerned without granting unnecessary adjournments.
With the aforesaid direction, present writ petition is disposed of.
