Heard learned counsel for the petitioner; the learned Standing Counsel for the respondents 1, 2 and 3; and perused the record.
The present petition has been filed against show cause notice cum suspension order dated 29.03.2018 passed by the District Magistrate, Azamgarh (Licencing Authority) calling upon the petitioner to show cause as also suspending the arms licence by taking recourse to power 17(3)(b) of the Arms Act.
It appears that there are two cases registered against the petitioner; one is of the year 2017 and the other is of the year 1986.
The contention of the learned counsel for the petitioner is that in so far as the case of the year 1986 is concerned, the petitioner has been acquitted.
Be that as it may, since an appeal lies against an order of suspension, under Section 18 of the Arms Act, before the Commissioner, the petition is disposed off with liberty to the petitioner to avail remedy of appeal.
