Heard learned counsel for petitioner and learned Standing Counsel for the State-respondents.
This writ petition has been filed seeking the following among other relief:-
"(i). issue a writ, order or direction, in the nature of mandamus commanding/directing to respondent no.
2 to decide the Suit NO. T201815510201324 (Shiv Kumar and others Versus Pyari Devi and others) under section 116 U.P. Revenue Code to within stipulated period."
The petitioner seeks expeditious disposal of a partition suit filed in the year 2018.
Perusal of the order sheet of the proceedings sought to be expedited reveals that the written statement has not been filed. Issues have also not been framed neither parties have led their evidence.
In view of the above, without entering into the merits of the controversy between the parties, I dispose of the writ petition with a direction to the respondent no. 2, Sub Divisional Magistrate (in short 'SDM'), Ghosi, Mau to consider and decide the partition suit expeditiously, preferably within a period of 18 months from the date of production of a certified copy of this order before him.
