Heard learned counsel for the parties.
Instant revision has been filed against the judgment and decree dated 28 May 2019 passed by the Additional Session Judge, Room No. 6, Farrukhabad in Session Trial No. 279 of 2016 (State vs. Kaushal and others) arising out of Case Crime No. 163 of 2016 under Section 498, 304B IPC and Section 3/4 D.P. Act, P.S. Merapur. Revisionist have been summoned on an application filed under Section 319 Cr.P.C.. The plea raised before the court below was that the revisionist at the time of commission of offence was at some other place.
It is not being disputed that the prosecution witness in her testimony has taken the name of the revisionist being present on the spot.
Learned counsel for the revisionist failed to point out any illegality, infirmity or jurisdictional error in the impugned order.
The revision is, accordingly, dismissed.
