Heard Sri Sandeep Kumar Srivastava, learned counsel for the petitioner and the learned Standing Counsel for the State-Respondents.
The petitioner in the writ petition is seeking a direction to the respondents to pay him interest at market rate on the amount of Rs.22,54,380/- w.e.f. 21.10.2014 till the actual date of payment upon proceedings under Section 56 (1A) of the Indian Stamp Act, 1899 being dropped. In this regard reliance has been placed upon a Government Order dated 16.10.2017, copy of which has been filed as Annexure-6 to the writ petition. A representation in this regard has also been submitted by the petitioner before the District Magistrate, Kanpur Nagar on 27.12.2017 (Annexure-8 to the writ petition).
No useful purpose would be served by keeping this writ petition pending.
This writ petition is, therefore, disposed of with the consent of the learned counsel for the parties with a direction to the respondent no.3, Collector/District Magistrate, Kanpur Nagar to take a decision on the petitioner's pending representation dated 27.12.2017 in the light of the Government Order dated 16.10.2017 within a period of two months from the date a certified copy of this order is received in his office.
It is made clear that the Court has not adjudicated the claim of the petitioner on merits.
