Sri Pradeep Chauhan learned counsel has put in appearance on behalf of respondents.
By means of the present petition, the petitioner seeks payment of his retiral dues which have remained unpaid since 31.03.2014. In the writ petition No.12929 of 2019, the petitioner has challenged the notice issued in the month of July, 2019 whereby he has been asked to vacate the official accommodation. It is also found therein that the petitioner has made all efforts to illegally grab the government accommodation by seeking conversion of the Nazul land (over which the house exists) into free hold in his name.
It appears that because of the said issue, the retiral dues of the petitioner have not been paid. An undertaking have been given by learned counsel for the petitioner after taking instruction from the petitioner that he would vacate the premises in question within a period of one month from today.
In case, the petitioner vacates the house-in-question within the period given above, the respondent would be under obligation to process all his retiral dues and make the payment immediately, thereafter. However, in case of non-vacation of the house in violation of the undertaking given herein, it would be open for the respondent to proceed in accordance with the law.
