Supplementary affidavit filed on behalf of petitioner is taken on record, which shall form part of the writ petition and challenge also.
Learned counsel for petitioner states that in an identical matter yesterday i.e. on 27.07.2021 in Writ - C No. 15863 of 2021 (M/S Shiv And Company Vs. State Of U.P. And 2 Others) conditional interim order has been passed, directing the petitioner to deposit 1/4rth of the demanded amount, hence he requests for the same relief.
The order dated 27.07.2021 passed in Writ - C No. 15863 of 2021 is extracted below:
"A supplementary affidavit has been filed which is taken on record.
It shall form part of the writ petition and it shall form part of the challenge also.
The State shall file its reply within eight weeks from today and explain as to whether the authorities have considered the judgment of this High Court in Writ-C No.17258 of 2020 and Writ-C No.16799 of 2020 (Vipul Tyagi v. State of U.P. and others) decided on 11.1.2021 or not?
Meanwhile, if the petitioner deposits 1/4th of the demanded amount, the order shall remain stayed.
List after eight weeks."
In view of above, the petitioner of this petition is also entitled for the same relief, which we grant.
List along with record of Writ - C No. 15863 of 2021.
