Heard learned counsel for the parties.
The order passed by the Deputy Director of Consolidation, Saharanpur dated 14.05.2010 is being challenged on the ground that under the operative portion of the order the chak of the petitioner has also been affected. It is stated that the petitioner was not a party to any of three proceedings referred to in the order of the Deputy Director of Consolidation dated 14.05.2010 and no notice was issued to him.
I am of the considered opinion that if the order dated 14.05.2010 is adverse to the petitioner and has been passed without notice and opportunity to him, he may approach the Deputy Director of Consolidation, Saharanpur himself at the first instance in respect of the grievances, which have been raised in the present writ petition.
This Court has no room to doubt that the Deputy Director of Consolidation, Saharanpur shall take appropriate action on the application to be filed by the petitioner strictly in accordance with law, preferably within six weeks from the date the application is so filed, after affording opportunity of hearing to the parties concerned.
With the aforesaid observation/direction the present writ petition is disposed of.
