Heard learned counsel for the applicant and learned A.G.A. for the State.
The applicant has approached before this Court praying for direction to the IInd Additional Sessions Judge/Special Judge(SC/S.T. Act) Ghazipur to conclude the proceedings of S.T. No. 198 of 2044 (State Vs. Rajendra Yadav and others) arising out of Case Crime No. C-3/2001 under sections 467, 468, 419, 420 I.P.C. and Section 3(1) X of SC/S.T.
Act P.s. Bhurkura District Ghazipur.
The argument is that trial is pending since 2001.Charges have been framed in the year 2001. It has been submitted that number of trial has been subsequently changed.Perusal of the order sheet shows that accused are avoiding appearance before the court below.
Without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court concerned to decide the aforesaid case within a period of one year from the date of production of certified copy of this order before him.
