Heard Shri Dhirendra Kumar Srivastava, learned counsel for petitioner and learned A.G.A. for State of Uttar Pradesh.
This writ petition has been filed for issuing of mandamus directing the respondent no. 2 and 3 i.e. Senior Superintendent of Police, Allahabad and Station House Officer, Police Station- Shahganj, Allahabad to ensure the fair investigation in pursuance of F.I.R. dated 21.06.2016 registered as Case Crime No. 73 of 2016, under Sections 409, 420, 506 I.P.C., Police Station- Shahganj, District- Allahabad.
It is alleged that F.I.R. was lodged on 21.06.2016 but police is not proceeding in the matter.
In the facts of present case, writ petition is disposed of with the direction to respondent no. 2 and 3 i.e. Senior Superintendent of Police, Allahabad and Station House Officer, Police Station- Shahganj, Allahabad to ensure the fair investigation in pursuance of F.I.R. dated 21.06.2016 registered as Case Crime No. 73 of 2016, under Sections 409, 420, 506 I.P.C., Police Station- Shahganj, District- Allahabad and submit the report by Investigating Officer under Section 173(2) Cr.P.C. within a period of four months.
