The present contempt application has been filed against the opposite party for willful disobedience of the order dated 15.2.2019 passed by this Court in Matters Under Article 227 No. 1034 of 2019 filed by the applicants whereby this Court has proceeded to observe as under.
"The sole prayer made in the instant petition is for issuing a direction to the trial court to decide the application for temporary injunction dated 19.4.2018 expeditiously.
The application for temporary injunction has been filed by the petitioners in Original Suit No.339 of 2018. A perusal of the order sheet reveals that the court is lying vacant.
Accordingly, liberty is granted to the petitioners to file an application for expeditious disposal of the application for temporary injunction soon after the Presiding Officer is posted in the court. In that event the court shall proceed to decide the application for temporary injunction expeditiously, without granting unnecessary adjournments.
The petition stands disposed of accordingly."
In the facts and circumstances, the Court is of the considered opinion there is no inordinate delay in deciding the application as such no contempt proceedings can be drawn against the opposite party at this stage. In case, there is any urgency in the matter, the applicants are at liberty to move an appropriate application before the Presiding Officer for expeditious disposal of the injunction application. This Court hopes and trust that the application in question would be considered and decided expeditiously in compliance of the Writ Court's order.
With the above, the present contempt application stands
disposed of.
