We have heard learned A.G.A. for the State.
We have perused the report of CMM, Kanpur Nagar dated 18.9.2018, which shows that the sole appellant Shishu alias Veer Bahadur has died in police encounter on 27.3.1998. The relevant documents in support of the said death have been annexed with the report of the C.M.M. Kanpur Nagar.The report also shows that informant has also expired.
In view of the aforesaid the appeal on behalf of sole appellant Shishu alias Veer Bahadur stands abated.
Accordingly, the appeal on behalf of sole appellant Shishu alias Veer Bahadur is being dismissed as having abated.
Let a copy of this order be certified to the court concerned for necessary consequential action.
As per office report dated 14.7.2017 lower court record has been received,the same be sent back to the court concerned for necessary consequential action.
