Heard Shri I.B.Singh, learned Senior Advocate appearing for the petitioner, learned Additional Government Advocate and Shri U.P.Singh appearing for the respondent nos.4 and 5.
In pursuance of this Court's order, Smt. Shivani Jaiswal, respondent no.5 is present alongwith the petitioner, who is also present in this Court.
It seems, after hearing learned counsel for the respective parties and Smt. Shivani Jaiswal that the chance be taken so that the matrimonial dispute which has arisen due to some misunderstanding between the parties can be resolved. While sending the matter to the Mediation & Conciliation Centre of this Court, it will be in the interest of the parties and also this Court feels that if the matter is forwarded to the Mediation and Conciliation Centre, parties may settle their dispute and may lead happy and peaceful life more when they have five years' old daughter between them.
Accordingly, we direct that this matter be sent to the Mediation & Conciliation Centre of this Court where the petitioner as well as respondent no.5 Smt. Shivani Jaiswal shall appear on 7.7.2010.
Mediation & Conciliation Centre of this Court, is requested to get the matter decided amicably between the parties and submit its report to this Court at an early date.Mediation and Conciliation Centre shall see that there should not be unnecessary adjournment in the disposal of the case.
The report be forwarded to this Court as soon as the matter is settled/decided between the parties.
Till submission of report by the Mediation & Conciliation Centre of this Court or till further orders of this Court, whichever is earlier, arrest of the petitioner in Case Crime No.3135 of 2010 under Sections 498-A, 504, 506, 325, 456, 307, 454 I.P.C. and Section 3/4 of Dowry Prohibition Act, Police Station Kotwali, District Unnao, shall remain stayed.
