Heard learned counsel for the petitioner, learned Standing Counsel for the State-respondent and Sri P.P. Srivastava, learned counsel appearing for respondent no. 2.
The petitioner took loan of Rs. 7,00,000/- from the State Bank of India (respondent no. 2) for purchasing a car on 09.2.2018. The aforesaid loan amount was repayable in seven years in monthly installments of Rs. 11,340/-. The petitioner till date has only paid a sum of Rs. 54,840/- but not regular monthly installments. Therefore, the car has been seized by respondent no. 2 on 6.12.2018.
Learned counsel for the petitioner submits that the petitioner is ready and willing to pay the entire amount of installments which is due up to December, 2018 and will continue making monthly installments as and when they fall due in future but the car may be released and handed over to him.
The petitioner, for the above purpose, may move an appropriate application/representation before the respondent no. 2 and it is expected that in case petitioner deposits the entire defaulted amount of installments up to 31.12.2018 along with the application, the respondent no. 2 shall consider for regularisation of his account and on petitioner's assurance on affidavit to pay regular monthly installments in future shall release the car whereupon the petitioner will continue to pay the monthly installments.
The respondent no. 2 shall consider the application in accordance with law within a fortnight.
With the aforesaid observation, the writ petition stands disposed of.
