High Court Of Judicature at Allahabad|27 April, 2018
|

JUDGMENT / ORDER

Court No. - 1
Case :- CRIMINAL MISC. WRIT PETITION No. - 10801 of 2018 Petitioner :- Shirin Framjee Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Ramesh Kumar Mishra Counsel for Respondent :- G.A.
Hon'ble Ramesh Sinha,J. Hon'ble Dinesh Kumar Singh-I,J.
Heard Sri R.K. Mishra, learned counsel for the petitioner, Sri N.K. Verma, learned A.G.A. appearing for the State and perused the impugned F.I.R. as well as material brought on record.
The relief sought in this petition is for issuing a direction to the respondents to conduct further investigation in case crime no. 364 of 2017 under sections 307, 120-B I.P.C., police station Kydganj, District Allahabad.
Learned counsel for the petitioner submits that the petitioner is the informant of the case. She lodged the present F.I.R. against respondent nos. 4 and 5 but during the course of investigation they have been exonerated by the police and fresh set of accused have been found to be involved in the incident against whom charge-sheet has been submitted, hence she has come up before this Court for issuance of a direction to the S.P. concerned for directing further investigation in the matter.
Learned A.G.A. opposed the prayer made in the present petition.
Considering the facts and circumstances and the submissions advanced by learned counsel for the parties, we are not inclined to interfere in the matter.
The petition lacks merit and is accordingly, dismissed.
